COCKS: "Considering the uncertainty of this mortal life, and being of sound mind and memory and that it is allotted to all men once to die, do make and publish this my last will and testament, that is to say principally that first of all I recommend my soul unto the hand of Almighty God, who gave it me, and the disposal of my body I leave to the entire discretion of my friends. With regard to my worldly estate, I give and bequeath and dispose of it in the manner and propositions following, that is to say: First, after all my just debts and funeral expenses is paid off, I give and bequeath unto my beloved wife POLLY COX, one horse beast, four cows, ten head of sheep, one half of all my household and kitchen furniture, and one hundred dollars provided she outlives me. Second, I give and bequeath to my eldest son, HENRY R. COX, one black boy named Daniel and if he should die leaving no issue, said boy is to return to my several heirs, all except my eldest daughter LOUCINDA QUILLIN , who is hereby excepted. Third, I give and bequeath unto JOHN M., J.H., and LEMUEL G. my second, third and fourth sons, all of my river farm lands that they now live on and occupy up to the mouth of the red cave, which is now divided between them. Fifth, I give and bequeath unto my eldest daughter, LOUCINDA QUILLIN, one dollar. Sixth, I give and bequeath unto ELIZABETH RICHMOND, my second daughter, one yellow girl named Nancy: Also five hundred dollars in money of solvent bonds. Seventh, I give and bequeath unto DESINDA BANNER, my third daughter, five hundred dollars in money: also a black girl named Rhoda. Eighth, I give and bequeath unto ASBERRY K., EMORY, and LOGAN COX my fifth sixth and seventh sons (and youngest) all my home farm, mills, and ------- and pertaining thereto, and one-half of my household and kitchen furniture, to be equally divided between each of them. I also give my above son, LOGAN, my seventh son, a black girl named Rachael. Ninth and lastly, as to all the rest, residue, and remainder of my personal estate, goods and chattel, of what kind and nature soever, I give and bequeath to the names and heirs, above named, to be equally divided among them all except my eldest daughter, LOUCINDA QUILLIN, who is excepted. I hereby appoint WILLIAM F. RICHMOND and LOGAN COX my sole executors to this my last will and testament, and I do hereby utterly disallow, revoke and dismiss all and every other testaments, wills, legacies, bequests, and executors by me, in any way named, written, and bequeathed, ratified and confirming this and no other to be my last will and testament. CARTER A codicil to the above will : In addition to the foregoing will, I ordain and declare that Jack and Lucy, two negro slaves, not directly expressed in foregoing will , I desire to be disposed of as follows: That is to say, after my death, that Jack and Lucy his wife, as above mentioned have the first choice of my several heirs, LOUCINDA QUILLEN excepted, they will go into the hands of, so as not to be separated as man and wife, and the one that they select as their master or mistress, he or she shall, and is hereby bound after the reception of said slaves as above named, in his or her possession, to pay a reasonable compensation by the year for the support and education of the minor orphan heirs (of any of my legal heirs in the will, LOUCINDA QUILLIN excepted) If there be no minor orphan heirs, the master or mistress of said slaves shall pay a reasonable compensation for the service of the said slaves, to be equally divided among my several heirs, LOUCINA QUILLIN excepted. I further desire the child or children, if the aforesaid heirs should think proper, may dispose of the issue equally, thus answering from the slaves above mentioned through my constituted executors, as expressed in the will in a manner they may think proper, LUCINDA QUILLIN excepted. And lastly, I ordain and declare the condition and regard to HENRY R. COX, my eldest son, mentioned in the second article of the will foregoing, whereas I have loaned HENRY R. COX the sum of three hundred and twelve dollars and fifty cents; Now providing the said HENRY R. COX shall refund the amount of money above specified then the boy Daniel remain his as the will mentions, if the said HENY R. COX fail to refund the money to me, I’ll keep the boy and pay to the said HENRY R. Walter Cocke left a will on 1 August 1735 at Soutyhmark Parrish, Surry, VA, US, WILL OF WALTER COCKE In the name of God Amen I Walter Cocke of the Parish of Southmark in the County of Surry, being sick and weak of body but of sound and perfect memory thanks be to almighty God, and calling to mind the uncertainy of this life do make and ordain this to be my last will and testament revoking all wills formerly made by me and for what worldly goods it hath pleased God to bless me with my just debts being first paid. I give in the following manner: 1. I give and bequeath to my son Thomas Cocke the Plantation and lands belonging to the same where I now live and his heirs as also my tract of land on the Otterdam containing seven hundred acres more or less to him and his heirs. 2. I give and bequeath to my son John Cocke five shillings current money. 3. I give and bequeath to my daughter, Anne Hamlin five pounds current money. All the rest of my estate both real and personal, I give to my son Thomas Cocke who I do appoint whole and sole executor of this my last will and testament.
