MacIntyre's notes say: Byrd says there were four children and names Raleigh and gives 8/19/1791 as marriage year. The book of marriage records I found says 1790 and lists the minister (see Judith's notes). The Surry co 1829 census shows 4 "Sheltan or Shelton" families: 2 Edward Shelton households, one Stephen and one Joseph (on same page). Copy in my files. For Stephen Sheltan: 1 male 0-10; 1 male 10-16; 1 male 16-26 (this could be Raleigh); one male 45+ (Stephen, HOH); 1 female 10-16 (this could be Judith); 1 female 16-26; 1 female 26-45; 1 female 45+. In the household of Joseph one male <10; one male 16-26 (Joseph); 1 female 10-16. Dorman gives the following for Stephen Chilton: Vol 14 pg. 127-8:"born ca. 1760, Culpeper co., VA. He enlisted in the fall of 1776 in Culpeper county for two years in Capt. George Slaughter's company in Col. Edward Stevens' regiment. When Slaughter was promoted John CHilton took command of the company [if Byrd's dates are right he'd be 10 years old. Don't know which John CHilton Dorman is referring to]. He was discharged at Valley Forge (Dorman's ref here is the "Bounty warrant, Stephen Chilton, Virginia State Library), was then given up to the British who kept him on an island in the St. Lawrence River chained to another prisoner for five or six months. He was then sent to New York where he was given his liberty (Dorman's ref: Revolutionary War pension application, Stephen Chelton, S.1189). After the war he lived in the part of Culpeper County which became Madison County until 1795 (Dormans ref: Culpeper co., VA and Madison Co VA personal property tax lists. His name is more frequently spelled Shelton on thises lists). He married 19 Aug. 1790 in Culpeper County Frances Norman (Dorman's ref: Katherine Lindsay Knorr, Marriages of Culpeper co. VA, 1781-1815 (Pine Bluff, Ark., 1954 p. 21) daughter of Joseph and Sarah (----) Norman (Dormans ref: George H.S. King, "Norman Family," Journal of North Carolina Genealogy, v. 11, pp 1518-19). In 1831 he was living in Surry co NC (ref King again) but by 1833 had moved to Woodford co., KY where he was living at the time of the 1850 census, aged 89." Byrd shows Raleigh and 3 other as children of Stephen Chilton and the following ancestry for Steven Chilton, but without any references save a remark about these being taken from actual family records. The VAGN material is well referenced, although I have not double checked them. Neither list Judith Chilton, but Judith as daughter of Stephen and Francis Norman Chilton is consistent with both and a number of other things: 1. see not on Judith Chilton about Stephen administering will of Robert Harris d 1816; 2. The 1820 Surry co NC census has listings that are consistent with both Raleigh's and Judith's birthdates; 3. Stephen Chilton was from Culpepper and our Judith was born in Culpepper (I'm not sure of ref for this other than Aunt Jean said something about the tombstone; haven't checked death records yet). Byrd lists Stephen Chilton's birthdate as Jan 1, 1766; Dorman says ca 1760. Bryd lists Stephen Chilton's deathdate as 1837; Dorman says by 1833, he had moved to Woodford co KY where he was living at the time of the 1850 census, aged 89. Byrd says Stephen Chilton's father was Richard Chilton who married Judith Carter. Byrd may have been inspired to find a lineage for his wife thru Judith Carter's family back to Charlemagne. Dorman lists this Judith Carter as married to Stephen's cousin William Chilton. William had a brother named Richard who also married a Judith. According to Dorman both William and Richard were sons of William who was a brother of THOMAS, the man Dorman gives as being Stephen's father. (see VAGN vol 14 esp pg. 123-28) Byrd however, gives the following and says this information is from actual family records: Stephen Chilton b Jan 1 1766 d 1839 son of Richard Chilton b ca 1740 Lancaster co & Judith Carter, Richard the son of William Chilton b ca 1720, d 1791, the son of William Chilton b 1700 d 1791, the son of Stephen Chilton d 1753 Mark Chilton of Prince WIlliam Co, VA d 1715, the son of John b. 1600 and Catherine Chilton of Chilston Manor in County Kent, Eng.. According to Byrd, John and Catherine had 3 sons: John and Thomas lived in Westmoreland Co VA and Mark, who lived in both Lancaster and Prince William Counties in VA and was the direct ancestor of the Surry CountyCHiltons. I was first inclined to go with Dorman because of all of the footnotes, until I looked closer and discovered there were no real good footnotes linking generation to generation except for wills that did not cite birthdates nor preclude aunts and uncles of the same name. For instance, Thomas Chilton on page 125 of vol 14 is listed as having "the following children and perhaps others" (five listed) but, while he may have had them (a will in this case was NOT cited) one or more of the ones mentioned may have been his brothers' children. Because Byrd and Dorman agree on the number of children for Richard and Dorman lists the spouses, this file will reflect Byrd in this instance and use Dorman's names and spouses. It is necessary to write the NC Genealogical Society to find out if Luther Byrd's family (esp his wife's family) still has the "actual family records" he refered to. So this file basically follows Byrd with additional notes and material from Dorman when it fits and a note for what it says something different. Dorman is questionable about the parentage of Byrd's William Sr. and suggests a different line than Byrd but without conviction.1 Stephen Chilton married Frances Norman. Stephen Chilton was born on 1 January 1776 at Culpepper, VA, US.1 He was the son of Richard Chilton and Judith Carter. Stephen Chilton was circa 1800 at Patrick; Moved to Patrick. |

DAVID and JEMUVIA (LEACH) COCKE sold most of their land holdings lying on Copper Creek in Russell County, Virginia before or by 1815. A portion of Scott County was carved from Russell County in 1814. The same land purchased by DAVID COCKE from SAMUEL AUXE (also spelled AUXER, OXER and AUXIER in other accounts) was sold five years later to William LEE for 100 pounds current money of Virginia. Deed Book 11 page 486 "On 24 April 1798, DAVID COX and JEMIMA his wife sold 180 acres of land at head of Copper Creek beginning at end of spur on Moccosin Ridge" When purchased from AUXE the name COCKE was used when sold to LEE the name was COCK. Deed Book I page 72 Russell County, Virginia shows Samuel OXER and Sarah his wife (no doubt the same AUXE as above) selling 200 acres of land to DAVID COCKE, being part of a larger tract of land granted to henry HAMLIN patent of 20 July 1790 on bank of Clinch River to Stoney Creek, down Stoney Creek to the Mill Race and to the Clinch River to the beginning. This land was recorded 23 February 1796 and was witnessed by Samuel PORTER, Henry SORK and James LEACH. (this James LEACH may have been related to JEMIMA LEACH, wife of DAVID C. COCKE/COX.) On 15 January 1817, DAVID COCKE, James ALBERT and John DUNCAN paid the delinquent taxes on the land of John BLACKMORE when he vacated his land and moved to Tennessee, by paying taxes from the year 1807 through the year 1814 they became the sole owners of Blackmore's Old Fort. Deed Book 1 " 1 5 January 1817, received of DAVID COX, James ALBERT and John DUNCAN $215 in full for 515 acres for John BLACKMORE'S delinquent taxes from 1807 to 1814" James ALBERT eventually became the sole owner of this property which he sold under a deed of trust to Goldman DAVIDSON, who in turn sold it to JAMES S. COCKE/COX, a son of DAVID C. COCKE/COX. Reel 26, page 76 --- Surveyed June 20, 1789 for DAVID COX, 250 acres of land by virtue of part of Land Office treasury warrant #11,343 dated 11 March 1782 lying in Russell County on waters of Copper Creek above of Clinch River and bounded as follows: To wit: Beginning at three white oaks standing on North side of Mockerson Ridge, corner to Joseph WHITELEY, thence north 15 S 102 to two spanish oaks on North side of said ridge n. 5 E. 60 poles to a spanish oak on S. side N. 23 W. 28 poles to two white oaks on the end of a spur to a bunch of lynns. Of property.3 He was born in 1748.4,5,6 He was the son of Henry Cocke.1,7 David C. Cocke married Jemima Leach before 1775.2 David C. Cocke served three months guard duty in the Revolutionary war by enlisting on 15 July 1780.8,6 He was an original member of the Stoney Creek Baptist Church. Prior to its official organization in 1801, most of the meetings were held in the home of David Cocke.1 He was listed in the 1820 census at Scott, VA, US.9 He left a will on 8 August 1826 which read as The Last Will and Testament of David Cock of Stony Creek, Scott County, Virginia In the name of God, amen. I David Cock, of Scott County being old and infirm, but of sound mind and disposing memory; and feeling a wish to dispose of my worldly estate in order to effect which, I hereby make and ordain this to be my last will and testament. In the first place I will that all my just debts and funeral expenses be punctually paid in a reasonable time after my death. 2ndly it is my will, and I hereby give to my beloved wife, Jemima, my plantation where I now live, with its appurtenances, two negro slaves, named Mem and Rhoda, my farming utensils, household and kitchen furniture, two work horses, six cows and calves such as she shall choose out of my stock, my sheep, hogs, and poultry, to have and hold said tract of land all the above mentioned property during her natural life. 3rdly, I give and bequeath to my son William my negro girl named Mary and any increase she may have before I die. 4thly I give and bequeath to my son Henry my negro boy named David. 5th I give and bequeath to my son David my negro girl named Sarah, and any increase she may have whilst I live. 6th I give and bequeath to my son James my negro boy named Jack. 7th I give to my daughter Betsey Brickey my negro named Bets or Betsy, with her increase as above. 8th I give and bequeath to my daughter Jemima Nelson my negro girl named Hannah with her increase as above. 9th I give and bequeath to my daughter Nancy Gillenwater my negro girl named Jenny with her increase as above. 10th it is my will after my debts and funeral expenses are paid, that my property not included in the above legacies should die before me, my will and desire is that their heirs get the portion to which their parents are entitled to by this will.
